Think Ahead - Tackle Smoking Habits Now!

You’d perhaps be forgiven for thinking that the new impending smoking laws due to be enforced under the Health Bill from 2007 onwards is more about not smoking in pubs and clubs than anything else. After all that is what much of the media coverage seemed to focus on. In fact the Health Bill requires that all enclosed public spaces and workplaces in England will be smoke-free from next summer onwards. Workplaces include offices, manufacturing plants, schools, shops, restaurants, voluntary organisations – you name it, chances are it will be included (except for those workplaces where people work and live on the same site). Even your work vehicles are likely to be caught by the ban since they are for all intents and purposes ‘enclosed workplaces’ under the impending law. Although clarification of ‘enclosed workplaces’ is due later this year we would advise every SME owner to be formulating strategies now for dealing with the Health Bill rather than leaving it until later.
Smoking is a contentious issue at the best of times but employers will be facing fines of up to £2,500 if they are found to be not actively enforcing the ban in their workplaces. And if they already provide smokers with smoking facilities and cigarette breaks, etc, they will have to be careful about rescinding them overnight. A reasonable consultation period is a must in order to lawfully change the custom and practice of a currently smoke-accepting environment to a non-smoking one.
